How real estate agents bill
Earns a commission set as a percentage of the sale price in the listing or buyer agreement, normally paid through the sponsoring broker out of the closing proceeds rather than by a separate check.
Real estate agents commonly use "Paid at closing from the settlement statement".
U.S. Bureau of Labor Statistics, Occupational Employment and Wage Statistics, May 2024: median hourly wage of Real Estate Sales Agents $27.08 (employees, not contractor rates).
Real Estate Agent invoicing tips
- Make the commission demand payable to your brokerage with the broker's license number, because agents are usually paid through their sponsoring broker, and a title company may refuse a demand made out to the agent alone.
- Quote the clause and percentage of the signed listing or buyer agreement on the commission line, since the closing agent checks your demand against that agreement before it goes on the settlement statement.
- Send the commission demand to the escrow or title officer well before closing, with the file number, so the figures appear on the closing disclosure instead of being chased afterwards.
- Bill marketing costs to the seller only when the listing agreement says they are reimbursable, and attach the vendor invoices, because sellers often assume photography and staging come out of your commission.
Real Estate Agent billing disputes to head off
- Referral fees and team splits sometimes get printed on the client-facing demand. Keeping internal splits off it and showing only the total owed to the brokerage avoids confusing the seller.
- A price reduction late in the deal changes the commission; recalculating the line from the final contract price, not the list price, prevents a corrected settlement statement at the closing table.
